Memorial no. 43074 Meredith et al to Crosbie et al

1 A memorial of an indenture or deed of settlement bearing
2 date the Twentieth day of January in the year of our Lord one thousand seven hundred
3 twenty and four made between Richard Meredith the elder Esquire Anne his wife and
4 Richard Meredith eldest son and heir all of Castle Island in the county of Kerry of
5 the first part Sir Maurice Crosbie of Ardfert in the said county Knight and William Crosbie of
6 Tubrid in the said county Esquire of the second part and Maurice Fitzgerald of Dingle in the
7 said county Esquire of the third part Reciting the Honourable the Lord Herbert by his Indenture
8 bearing date the twentieth day of March one thousand six hundred fifty and six did
9 give grand bargain and sell unto William Brown of Montgomery Gent. since deceased
10 and his Heirs all that and those the Messuage Tenements and Lands and Appurtenances
11 containing one plowland and an half commonly Tyrenagoose and InchymacMarcus
12 commonly known by the name of Lagharron lying and being within the Seignory
13 of Mount Eagle Loyall in the county of Kerry aforesaid To hold to the said William
14 Brown and the Heirs of his body then to John Brown and the Heirs of his body then
15 to Thomas Brown and the Heirs of his body then to Lord Herbert and his Heirs forever
16 and under the yearly rent of an half penny an acre and also Reciting that the said
17 William dying without Issue Male the said Lands descended and came to Anne his
18 only daughter the wife of the said Richard Meredith the Elder and further Reciting
19 that the Right Honourable Charles Earl of Orrery by his Indenture of Lease bearing date
20 the twenty fifth day of June one thousand and seven hundred twenty and four for the
21 considerations therein mentioned did demise set and to farm let unto the said Richard
22 Meredith the Elder all that and those the Towns Farms Lands Tenements and
23 Hereditaments of Killfallen als Killallen containing by estimation three plowlands
24 and two plowlands of Ballymac Lierse and three plowlands of Ballymac Daniel
25 according to their ancient mears and bounds situate lying and being in the
26 Barony of Trughanackmy and county of Kerry aforesaid To hold for ninety nine
27 years if the said Richard Meredith the younger William and Anne Meredith sons and
28 daughter of the said Richard the Elder or any of them should so long live at and under
29 the yearly rent of ninety pounds for each of the first twelve years and one hundred pounds
30 per annum for the remainder of the said term with a clause for adding a Life if any of the
31 Lives then named should drop within the first twelve years and also a power at any
32 times to put the Life of such woman the said Richard the younger should marry in the
33 place or stead of any of the lives then named And likewise renting at marriage then
34 shortly to be had between the said Richard the younger and Honora daughter to the said
35 Maurice Fitzgerald in consideration whereof and of five hundred pounds marriage
36 portion and other considerations therein mentioned the said Richard the Elder and Ann his
37 wife and Richard the younger did thereby covenant to Levy a fine unto the said Maurice Fitzgerald 
38 and his Heirs of all those the Lands of Tyrenagoose and InchymacMarcus and also to suffer 
39 a common recovery of said Lands to the use of Richard the Elder for life then to Richard
40 the younger for life then to Maurice Fitzgerald and his heirs during the life of Richard
41 the younger to support Contingent Remainders and from and after the decease of
42 Richard the younger to his first and other sons by the said Honora and the Heirs
43 Males of the body of such son and sons and for default of such issue to the said William
44 Meredith and the heirs male of his body and for want of such issue to to the right
45 heirs of Richard the Elder for ever with a Provisoe empowering the person actually
46 in possession to Lease said premises for three lives or one and thirty years at the
47 full improved rent and the said Richard Meredith the Elder in consideration of said
48 marriage and said marriage portion did thereby assign and make over unto the said
49 Maurice Crosby And William Crosbie and the survivor and survivors Executors and administrators of
50 such survivor all that and those the Lands of Killkallen and Kilallen Ballymac Leirse
51 and Ballymac Daniel aforesaid to hold for the residue of said term upon trust to
52 permit Richard the younger to hold and enjoy the same and receive the rents and
53 profits thereof for his life and if he should die before the said Honora leaving issue
54 then upon Trust to pay unto the said Honora sixty pounds annually clear for Life
55 for her Joynture payable half yearly and if she[?] dies before her without issue
56 then to pay her the additional sum of twenty pounds annually for Life with power to distrain
57 for said sixty pounds and twenty pounds if in arrear and also another provisoe that
58 the first payment of the said twenty pounds should not commence after eleven
59 years from the date of said deed and what should remain of the said rents and profits
60 should then and after the decease of the said Honora the entire rents and profits go to
61 such child or children of the said Richard and said Honora as the said Richard the younger
62 by Deed or Will should appoint and for want of such appointment to be equally
63 divided between them Richard the younger Covenants to surrender the Lease and to
64 take a new one and put the Life of the said Honora instead of one of the Lives
65 therein mentioned and also a Covenant that if the profits of said Lease Lands
66 should not answer the payment of the said sixty pounds and twenty pounds
67 such deficiency after the decease of Richard the Elder should be made up out of
68 the profits of the said Fee Farm Estate together with another provisoe that after the
69 decease of Richard the Elder should be made up out of the profits of the said Fee Farm
70 Estate together with another provisoe that after the decease of Richard the Elder
71 it should be lawfull for Richard the younger having no Issue Male to charge the
72 said Feefarm Estate with any sum of money not exceeding three hundred pounds
73 for Daughters in such proportion as the said Richard the younger by Deed or Will
74 should direct and for want of such direction to be equally divided between and
75 the said Deed of Settlement is executed by all the parties thereto in the presence
76 of Thomas Margell of Provish in the county of Limerick Esquire John Sulivan of
77 Gallurus in the County of Kerry and William Scannell of Tralee and said county
78 of Kerry and this Memorial is witnessed by the said William Scannell and
79 Thomas Hebert of Currens in said county of Kerry and is required to be registered
80 to be registered by me the said Richard Meredith the younger in witness thereto put
81 my hand and Seal this third day of April one thousand seven hundred and thirty 1730 
82 Richard Meredith signed and sealed in presence of us - Thomas Herbert William Scannell
83 The above mentioned William Scannell came before me this day and made oath that he saw
84 the Deed of Settlement of which the above is a Memorial duly signed sealed and executed
85 by all the parties thereto above mentioned and also saw the above Memorial duly signed sealed
86 and executed by all the partys thereto above mentioned and also saw the above Richard
87 Meredith the younger sign and the seal of the above memorial and this Dept. Dept. deposeth
88 that he this Dept. is a subscribing witness to both be said deed and the memorial -
