In the name of God Amen. I Richard Meredith of
Castle Island in the County of Kerry Esq. Considering the
uncertainty of this mortal life and being of sound and perfect
mind and memory blessed be the Almighty God for the same
do make and publish this my last Will and Testament in manner
and form following that is to say
I give and bequeath unto my Son David Meredith and to my
Daughter Anne Meredith and their respective Heirs as tenants in
Common & not as joint tenants all the real and personal Estate
of what nature and kind soever it be that I shall die possessed of
to be equally divided between them share and share alike subject
to the payment of twenty Pounds a year to my dear and beloved
Wife which I leave her as an addition to the Jointure of Sixty Pounds
a Year which she is entitled to by virtue of our marriage Articles and
in case it should so happen that either my said Son David or my
Daughter Anne should die before their respective days of marriage
then my Will is that the Fortune which I hereby leave to such Person
so dying shall go to the Survivor
And Whereas on the marriage of my son Richard wih Frances
Greene his now Wife I settled my real Estate and fee farms to my
own use during my life and after my decease to the use of my said
Son Richard during his life and after his decease to the use of the
first second third and every other son in tail male successively to
be begotten on the body of said Frances and for want of such
issue male of said marriage then to the use of my own right Heirs
for ever as in and by indented Articles of intermarriage bearing
date the thirtyeth day of November which was in the year one
thousand seven hundred and fifty two as in and by said
Articles and Indorsements thereon may more at large appear Now
in case my said son Richard shall happen to survive his present
Wife leaving no issue male I do publish and declare my Will
to be that said several Estates and every part thereof so settled on
my said son Richard shall be and remain to the use and behoof
of his first second third and every other son in tail male
successively and the Heirs male of the body and bodies of such
Son and Sons lawfully issuing to be begotten on the body of any
after taken Wife subject to the payment of two thousand Pounds to my
son David and one thousand Pound to my Daughter Anne and
their Issue and in case either of them should die without issue
then my Will is that the Survivor shall be entitled to said
Sum of three thousand Pounds - And I do also impower my
said son Richard to charge and incumber my said several
Estates with the Sum of five hundred Pounds [insertion] as a Provision and fortune for each and every of his Younger Children so as that the whole shall not exceed the Sum of two thousand Pounds [end of insertion] by any
such after to be taken Wife And I do also impower my said
Son Richard to settle a Jointure on any after taken Wife of
one hundred Pounds a Year to issue out of my said several
Estates And for want of issue male in my said son Richard
then my Will is that my said Estate and every part thereof shall
be and remain to the use and behoof of my Son David during
his natural life and after his decease to the use and behoof of his
first second third and every other Son in tail male
successively and the Heirs male of the body and bodies
of such Son and Sons lawfully issuing to whom I do
hereby give power of settling a Jointere not
exceeding two hundred Pounds a Year on any
Wife he shall marry and also of charging my
said Estate and every part thereof with a Sum
not exceeding three thousand Pounds as a Provision
for younger Children And for want of issue
male in my said son David then my Will is
that the said several Estates shall be and remain to the
use and behoof of my Brother William Meredith and
to his first and every other Son in tail male successively
one after another subject to the payment of two thousand
Pounds to the issue of my Daughter Anne to be
divided in such proportions amongst them as she
shall think proper And for want of such division to be
equally divided between them share and share
alike - And for want of issue male in my said
Brother then my Will is that the said several Estates
shall be and remain to the use and behoof of my Daughter
Anne during her natural life and after her decease to the
use and behoof of her issue male and their Heirs male the
Eldest always taking place and assuming the surnam
of Meredith and for want of such issue male in my said
Daughter Anne then to the issue female of my son Richard
and to their Heirs male the eldest always taking place
and assuming the surname of Meredith and for want of
such issue female in the said Richard then to the issue
female of my Son David and their Heirs male subject to
the above mentioned conditions I do hereby nominate
and appoint my said Brother William Meredith and
John Godfrey of Bushfield both in the County of Kerry
Esqrs, Executors of this my last Will and Testament
intreating them to take the trouble thereof on them hereby
revoking all former Wills by me heretofore made
In Witness whereof I have hereunto set my hand and
seal this eleventh day of November one thousand seven
hundred and fifty eight

Sealed published and declared by the above named
Richard Meredith to be his last Will and Testament
in presence of us who have hereunto subscribed our
names as Witnesses in presence of the Testator and of
each other and When Edward Tuohy by the special
appointment and direction of the said Testator signed the
[insertion] name of the said Richard Meredith [end insertion]
the Testator to this his last Will and Testament
And When the words (and their respective Heirs as Tenants
in Common and not as Joint Tenants) and the words (so
settled on my said Son Richard) and the words
[insertion] (of the body or bodies of such Son and Sons lawfully issuing) and the words [end insertion] (by any
such after to be taken Wife) and the words (of the body and bodies
of such son and sons lawfully issuing) and the words (and
to his first and every other Son in tail male successively one
after another) and also the words (and for want of such
divivion to be equally divided between them share and share
alike) were firot above interlined before the publishing of
the above last will and testament.
